General

• By commissioning me, you agree to have read and understood my ToS.
• I reserve the right to cancel or decline your commission for any reason.
• I do not accept commissions based on a FCFS basis. I will only accept what I think I can manage.
• In case of conflict or violation of my ToS, I will immediately cancel the commission and issue a refund. Additionally the client will be banned from requesting my services in the future.

Payment

• Payment must be taken 100% upfront to start the commission.
• Payment must be made through VGen or paypal invoices.
• The currency used or converted into: $USD. The client is responsible for their own currency conversion fees.
• Do not fret if my prices fluctuate; The price agreed upon prior to the change will be on the invoice.

Revisions

• Minor revisions are free at any stage.
• Major revisions such as; entire pose, outfit or background redraw are only allowed at the sketch phase and are free for up to 2 revisions. Each additional revision will be $5 extra and will delay the guaranteed delivery date.
• Revisions are not available for "Surprise Me" and "YCH" commissions.

Deadlines and Delivery

• ETA: 3 days min - 3 months max
• In case of delay, I will communicate with the client.
• I do not allow deadlines set by the client nor do i take rush orders.
• Delivery will be through VGen or the client's preferred SNS.

Files

• The client must inform the artist if they need a specific canvas size for purposes such as printing.
• I don't provide speedpaints, source or layered files of the commissioned artwork(s).

Commercial Use

• The client must state if they plan to use the commissioned artwork commercially on the order form.
• Tier 1: 50% of the Base Price for Streaming / monetizable video content. The fee is only applied if my work is directly being used for streaming or monetary gain.
• Tier 2: Base Price x2 for reproduction and reselling of my work as merchandise.

Copyright / Usage Policy

The artist:
• Unless a NDA is stated, the artist retains all the rights to share, display and advertise their work on websites, SNS, portfolio, etc.The client:
• Credit must be provided when sharing the work on SNS.
• The client can not use my work for blockchain-related technology such as NFTs, Cryptocurrency, AI training, or generating AI images.
• The client cannot cut up my work to turn into a VTuber model.
• The client cannot resell my work/designs for a higher price.
• The client may not trace, modify or claim my work as their own creation.

Refunds

• Once the commission is started, there will be no refunds.
• If I'm unable to finish the commission, i will issue a full refund.
• In case of a forced chargeback, the client will lose all rights to the commissioned artworks and be banned from requesting my services in the future.

Communication

• The client is expected to be communicative when sent updates, approving or requesting a revision to proceed.
• If the client is unresponsive to updates, the artist reserves their right to extend the guaranteed delivery date.
• The artist promises full transparency with the client and will send updates when available.
• Asking for updates too frequently is discouraged.
